{"id":8847,"date":"2026-03-10T14:02:22","date_gmt":"2026-03-10T14:02:22","guid":{"rendered":"https:\/\/cosro.com\/?p=8847"},"modified":"2026-03-10T14:03:19","modified_gmt":"2026-03-10T14:03:19","slug":"radar-ambiental-conama-atualiza-regras-para-ciencia-de-orgaos-gestores-de-ucs-em-processos-de-licenciamento-ambiental-2","status":"publish","type":"post","link":"https:\/\/cosro.com\/en\/radar-ambiental-conama-atualiza-regras-para-ciencia-de-orgaos-gestores-de-ucs-em-processos-de-licenciamento-ambiental-2\/","title":{"rendered":"Radar Ambiental: CONAMA updates rules for notification of management bodies of conservation units in environmental licensing proceedings"},"content":{"rendered":"<p> The National Council for the Environment (\u201cCONAMA\u201d) published Resolution No. 508\/2025, which amended Article 5 of CONAMA Resolution No. 428\/2010<a href=\"#_ftn1\" id=\"_ftnref1\">[1]<\/a> and introduced significant changes to the steps that must be taken to ensure that management bodies are notified in environmental licensing proceedings for projects that may affect Conservation Units or their buffer zones and that <strong>are not subject<\/strong> to an Environmental Impact Assessment and Environmental Impact Report (\u201cEIA\/RIMA\u201d).<\/p>\n\n\n\n<p>The changes created by CONAMA Resolution No. 508\/2025 make the consultation procedure more transparent by defining deadlines, form and content of the communication, as well as guidelines for the technical opinion of the Conservation Units management body. Among the main changes, the following deserve highlighting:<\/p>\n\n\n\n<figure class=\"wp-block-table is-style-regular\"><table class=\"has-fixed-layout\"><tbody><tr><td class=\"has-text-align-center\" data-align=\"center\"><strong>Timing and Deadline for Notification<\/strong><\/td><td>&nbsp;<br>\u2022 Notification to the Conservation Unit management body must occur prior to the issuance of the environmental license, within <strong>15 days<\/strong> of receiving the environmental studies submitted by the entrepreneur.<br>&nbsp;<br>\u2022 The management body has up to <strong>30 days<\/strong> to present its technical contributions. This period may be extended for another 30 days with justification, except for low-impact projects.<\/td><\/tr><tr><td class=\"has-text-align-center\" data-align=\"center\"><strong>Criteria for Buffer Zone <\/strong><\/td><td>\u2022 Previously, the 2,000-meter distance rule for Conservation Units without Buffer Zones had a time limit linked to 2015. Now, notification is mandatory for any project within <strong>2,000 meters<\/strong> of a Conservation Unit that does not have a demarcated Buffer Zone, regardless of when the Conservation Unit was created.<br>&nbsp;<br>\u2022 The proximity notification procedure (2,000m limit) <strong>does not apply<\/strong> to Consolidated Urban Areas, Environmental Protection Areas (\u201cAPAs\u201d), and Private Natural Heritage Reserves (\u201cRPPNs\u201d).<\/td><\/tr><tr><td class=\"has-text-align-center\" data-align=\"center\"><strong>Compliance with Conservation Unit Restrictions in Licensing<\/strong><\/td><td>\u2022 In the preparation of environmental studies and documents that support environmental licensing, it is mandatory to observe the restrictions defined in the act of creating the Conservation Unit and, when it exists, the rules of its Management Plan.<\/td><\/tr><tr><td class=\"has-text-align-center\" data-align=\"center\"><strong>Technical Contributions and Deadlines<\/strong><\/td><td>\u2022 The pronouncements of the Conservation Units management body must be directly correlated to the environmental impacts affecting the protected area.<\/td><\/tr><tr><td class=\"has-text-align-center\" data-align=\"center\"><strong>Non-Binding Consultation<\/strong><\/td><td>\u2022 The comments and suggestions presented by the UC management body are <strong>merely advisory<\/strong>, and it is up to the environmental licensing body to decide on their relevance and possible integration into the license conditions.<br>&nbsp;<br>\u2022 The omission or untimely comment by the Conservation Unit management body does not constitute an obstacle to the continuation of the environmental licensing proceeding.<br>&nbsp;<br>\u2022 These provisions are in line with Article 42, I of the new General Environmental Licensing Law (Federal Law No. 15.190\/2025).<a href=\"#_ftn1\">[2]<\/a>.<br><br><br><\/td><\/tr><tr><td class=\"has-text-align-center\" data-align=\"center\"><strong>Urban infrastructure depends on prior approval<\/strong><\/td><td>\u2022 The implementation of water supply, sewage, electricity, and other urban infrastructure components within Conservation Units is subject to prior approval from the respective management body, as established in Article 46 of Federal Law No. 9,985\/2000 (which establishes the National System of Conservation Units \u2013 \u201cSNUC\u201d).<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p>It is worth noting that, in cases where the project has a potentially significant impact (and therefore depends on the presentation of an EIA\/RIMA), the legal obligation to obtain prior authorization (approval) from the managing body of the protected area <strong>remains <\/strong>, as established by SNUC.<a href=\"#_ftn1\">[3]<\/a>.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p><\/p>\n\n\n\n<p><a href=\"#_ftnref1\" id=\"_ftn1\">[1]<\/a> Disp\u00f5e, no \u00e2mbito do licenciamento ambiental, sobre a autoriza\u00e7\u00e3o do \u00f3rg\u00e3o respons\u00e1vel pela administra\u00e7\u00e3o da Unidade de Conserva\u00e7\u00e3o (UC), de que trata o art. 36, \u00a7 3\u00ba, da Lei n\u00ba 9.985, de 18 de julho de 2000 , bem como sobre a ci\u00eancia do \u00f3rg\u00e3o respons\u00e1vel pela administra\u00e7\u00e3o da UC no caso de licenciamento ambiental de empreendimentos n\u00e3o sujeitos a EIA-RIMA e d\u00e1 outras provid\u00eancias.<\/p>\n\n\n\n<p><a href=\"#_ftnref1\">[2]<\/a> Art. 42.
